By the same Law number 129/2004, franchising know-how is defined as “a wealth of non-patented practical knowledge deriving from experiences and tests carried out by the franchisor”.
So, franchising know-how is a set of information, operational skills, experiences, knowledge necessary to carry out a certain activity and which, however, are not protected by patent protection.
This lack of protection is due to one of the following reasons:
